Overview

Welcome to The Wine Concierge.

Throughout these Terms of Service ("Terms"), the terms "The Wine Concierge," "we," "us," and "our" refer to The Wine Concierge, a Washington, DC-based wine retailer, concierge service, event provider, and e-commerce business.

Our website, online store, wine clubs, memberships, educational content, event registration services, and related offerings (collectively, the "Services") are operated through Shopify and other authorized service providers.

By visiting our website, creating an account, making a purchase, registering for an event, joining a membership program, or otherwise using our Services, you agree to these Terms and our Privacy Policy.

If you do not agree, please do not use our Services.

1. Eligibility and Age Verification

Because we sell alcoholic beverages, you must be at least 21 years of age to:

• Purchase wine
• Join a wine club
• Register for wine-related experiences
• Use any portion of our Services involving alcohol

By using our Services, you represent and warrant that:

• You are 21 years of age or older;
• Any alcohol purchased is intended solely for personal consumption;
• You will not resell any products purchased from The Wine Concierge.

We reserve the right to require age verification at any time and to cancel any order that cannot be lawfully fulfilled.

A valid government-issued ID may be required upon delivery.

2. Accounts and Security

You may be required to create an account to access certain Services.

You agree to:

• Provide accurate and complete information;
• Keep account information current;
• Maintain the confidentiality of your password;
• Notify us immediately of unauthorized account activity.

You are responsible for all activity occurring under your account.

3. Products and Availability

The Wine Concierge strives to maintain accurate product listings; however:

• Product descriptions may change without notice;
• Vintage availability may change;
• Inventory levels fluctuate;
• Product images may vary from actual products.

All product offerings are subject to availability.

We reserve the right to limit quantities and discontinue products at any time.

4. Vintage Availability and Substitution Policy

Wine is an agricultural product with naturally changing vintages and limited availability.

Unless you specifically communicate a required vintage before fulfillment, The Wine Concierge reserves the right to substitute:

• A newer vintage from the same producer;
• The same varietal or wine style;
• A wine of equal or greater value and comparable quality.

For wines priced under $25 or orders of fewer than six bottles, vintage substitutions may occur without additional customer approval.

If a specific vintage is essential to your order, you must:

• Include a note during checkout, or
• Contact us before your order is fulfilled.

Substitutions made under this policy are not considered incorrect or defective.

5. Orders

Submission of an order constitutes an offer to purchase.

We reserve the right to:

• Refuse any order;
• Limit quantities;
• Cancel an order at our discretion;
• Correct pricing or inventory errors;
• Suspend transactions requiring additional verification.

If an order is canceled after payment is received, a full refund will be issued.

6. Pricing and Payments

All prices are listed in U.S. dollars.

Applicable taxes, shipping fees, handling charges, and regulatory fees are calculated at checkout.

By placing an order, you authorize The Wine Concierge and its payment processing partners to charge your selected payment method.

If multiple payment methods are on file and the primary method fails, you authorize us to attempt processing through an alternate payment method associated with your account.

7. Shipping and Delivery

Wine shipments are subject to federal, state, and local laws.

We ship only to states where legally permitted.

Customers are responsible for ensuring:

• Their state allows direct shipment;
• Delivery information is accurate;
• An individual age 21 or older is available to sign for delivery.

We reserve the right to cancel orders that violate state shipping restrictions.

Delivery dates are estimates only and are not guaranteed.

8. Weather Holds

To protect wine quality, we may delay shipments during:

• Excessive heat
• Freezing temperatures
• Severe weather events
• Natural disasters

If weather conditions present a risk to product quality, we may delay shipment until conditions improve.

9. Shipping Restrictions and State Compliance

Certain states restrict the amount of wine that an individual or household may receive annually.

If an order exceeds legal limits or cannot be shipped due to regulatory restrictions, we may:

• Modify the order;
• Delay shipment;
• Cancel the order; or
• Issue a refund.

Compliance with alcohol shipping laws is a condition of purchase.

10. Returns and Refunds

All returns, replacements, credits, and refunds are governed by our Return & Refund Policy.

By making a purchase, you acknowledge and agree to that policy.

11. Wine Club Memberships

The Wine Concierge may offer wine club programs, including but not limited to:

• The Club
• Premier Club
• Future membership offerings

By joining a membership program, you authorize recurring charges associated with your membership selections.

To avoid processing of an upcoming shipment, cancellation requests must be received at least seven (7) days before the scheduled shipment date.

12. Events and Experiences

Event registrations may be subject to separate policies.

Unless otherwise stated:

• Event tickets are non-refundable;
• Registrations may be transferable at our discretion;
• We reserve the right to modify event details, venues, menus, speakers, wine selections, or schedules.

If an event is canceled by The Wine Concierge, a refund or credit will be provided.

13. Gift Cards

Gift cards:

• Are non-refundable;
• Cannot be redeemed for cash except where required by law;
• May only be redeemed through The Wine Concierge;
• Do not expire.

Lost or stolen gift cards may not be replaceable.

14. Promotions and Referral Programs

Promotions, discounts, referral incentives, and membership benefits:

• May be modified or discontinued at any time;
• Cannot be combined unless expressly stated;
• Have no cash value;
• Are subject to additional terms.

We reserve the right to revoke benefits obtained through fraud, abuse, or violations of these Terms.

15. Acceptable Use

You agree not to:

• Violate any law;
• Interfere with website operations;
• Attempt unauthorized access to systems;
• Submit false or misleading information;
• Use bots, scrapers, AI agents, or automated data collection tools without written authorization;
• Engage in harassment, abuse, or fraudulent conduct.

Violations may result in account suspension or termination.

16. Intellectual Property

All website content, including:

• Logos
• Branding
• Product descriptions
• Images
• Educational content
• Graphics
• Text
• Videos

is owned by The Wine Concierge or its licensors and protected by applicable intellectual property laws.

No content may be reproduced or redistributed without written permission.

17. User Reviews and Feedback

By submitting reviews, comments, testimonials, photographs, or other content, you grant The Wine Concierge a perpetual, royalty-free, worldwide license to use, publish, reproduce, and display that content for marketing and business purposes.

You represent that you own the rights to any content you submit.

18. Third-Party Services

Our Services may integrate with:

• Shopify
• Payment processors
• Shipping providers
• Event registration platforms
• Marketing platforms
• Social media providers

These services operate under their own terms and privacy practices.

The Wine Concierge is not responsible for third-party services or websites.

19. Disclaimer of Warranties

THE SERVICES, PRODUCTS, CONTENT, AND INFORMATION PROVIDED BY THE WINE CONCIERGE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WINE CONCIERGE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WINE CONCIERGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Nothing in these Terms limits rights that cannot be waived under applicable law.

21. Indemnification

You agree to indemnify and hold harmless The Wine Concierge, its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, and expenses arising from:

• Your violation of these Terms;
• Your misuse of the Services;
• Your violation of any law or third-party rights.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of the District of Columbia, without regard to conflict-of-law principles.

Any dispute not subject to arbitration shall be resolved exclusively in the courts located in Washington, DC.

23. Dispute Resolution and Arbitration

Except where prohibited by law, any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).

Both parties waive the right to a jury trial and participation in class-action proceedings.

Nothing in this provision prevents eligible claims from being brought in small claims court.

24. Changes to Terms

We may modify these Terms from time to time.

Updated Terms will be posted on our website and become effective upon posting unless otherwise specified.

Your continued use of the Services constitutes acceptance of revised Terms.
